1. Content of Agreement:
This agreement is made between you (as the "Buyer") and AV Brand. AV Brand is the operating name of ActionVan's van & SUP accessory store & Stand Up Paddle-board School. Company owners Andrew Wood & Mary Wood.

 

2. General Information:
AV Brand is a Business Partnership & is not VAT registered, all prices shown are inclusive of VAT.

 

3. Product:
AV Brand will endeavour to ensure items are described and photographed as accurately as possible, but please note that sizes, colours and designs may vary.

Also that any calculations, estimates and projections that it makes in the provision of the Product(s) will be done using prudent methods established by ActionVan as an expert in this area.

 

4. Payments and Refunds/Returns:
AV Brand requires a payment to be received in full before shipping to the Client except where agreed at AV Brands own discretion.

Prices are subject to change without notice.

Items must be returned as sold, AV Brand will only  accept items that have not been used, altered or worn are in good condition and in the original packaging (with your customer advice note).

Returns will only be accepted within 14 days of the date of receipt and we will refund the purchase or send you a replacement as AV Brand sees fit.

If you wish to order additional items it will be treated as a new order.

Any guarantee from AV Brand is in addition to your statutory rights.

5. Limitation of liability
AV Brand does not represent or warrant, at any time during the period of this contract, that access to or use of the Product(s) will be uninterrupted or error-free or that the Product(s) supplied is accurate or correct or that it meets any particular criteria of performance or quality.

The Product(s), its contents and conclusions, are based on extrapolated calculations and are prognoses and opinions and must be interpreted as such.
AV Brand shall not be liable for any direct or indirect errors in the Product(s) or in its conclusions and advice.

You shall accept sole responsibility for and AV Brand shall not be liable for the use of the Product(s) by you (or any user) and you shall hold AV brand harmless and fully indemnified against any claims, costs, damages, loss and liabilities arising out of any such use.

AV Brand shall have no liability whatsoever for any liability of the Buyer to any third party which might arise.

The Buyer assumes full responsibility and risk of, and AV Brand shall not be liable for, any loss which results from any transactions or decisions made by the Buyer on the basis of the Product(s) supplied by AV Brand.

None of the terms of this contract shall operate to exclude or restrict the liability of AV Brand for death or personal injury resulting from the negligence of the Seller.

6. Non-Disclosure
AV Brand and any third party associates agrees that, except if directed by you, it will not at any time during or after the term of this agreement disclose any confidential information regarding the Buyer. Likewise, the Buyer agrees that it will not convey any confidential information about AV Brand or their order to another party.

 

7. Privacy Policy
AV Brand and any third party associates shall use information provided by you in relation to this agreement in accordance with the Data Protection Act 1998 and also for the following purposes 
1) To identify the you in communications with AV Brand
2) To contact you from time to time to offer services or products which may be have interest to or benefit you.

8. Changes to these Terms and Conditions
AV Brand reserves the right to add to or change the provisions contained in these Terms and Conditions at any time. 

If you do not wish to accept the changes to the Terms and Conditions you must terminate this agreement.
You are required to provide AV Brand with complete and accurate registration details and to update your information if it changes. If you fail to do so you will be in breach of this agreement.
